Statement:
YES ___ PHYSICAL CONDITION: I have carefully read the description of this trip, and in particular have considered the description of the physical demands of the trip and the Activity Scale. I am in proper physical condition to participate in the trip, and if my condition changes such that participation may become unsafe, I will withdraw from participating.
YES ____ RISKS: I understand that that there are risks inherent in participating in birding tours. I understand that I may be exposed to hazardous conditions, which may include inclement weather; uneven, slippery, frozen, ice- or snow-covered terrain; poisonous plants; roads, trails and pathways that are not regularly patrolled or inspected; and vehicular accidents while travelling to and between trip locations. I understand that as a result of the known and unknown risks associated with the birding tour, I may experience damage to my property, physical injuries, bodily harm, illness or death.
YES ____ ACCEPTANCE OF RISK AND WAIVER/RELEASE OF LIABILITY: I accept the risks inherent in the trip voluntarily, and on behalf of myself, my heirs, next of kin, executors, legal representatives, successors and assigns, hereby release, discharge and hold harmless Jon Ruddy and Eastern Ontario Birding from any and all losses, rights and claims for injury, loss, expenses or damage resulting from my participation in the trip or travelling to or from the trip and any other associated events or activities. I intend this Release to apply to all claims, regardless of whether founded in whole or in part on any negligent act or omission of any released party. I agree that this release and any claims I may be bring will be subject to the laws of the Province of Ontario, and the exclusive jurisdiction of the Courts of the Province of Ontario. I agree that this release is intended by all parties to be as broad and inclusive as is permitted by the laws of Ontario, and if any portion of this Release is held invalid, I agree that the balance shall continue in full force and effect.
YES ___ BIRDING ETHICS: I acknowledge that the welfare of birds comes first. I agree to accept Jon Ruddy’s direction as to appropriate conduct in the field. I also agree to refrain from posting the location of birds prone to human disturbance, such as nesting birds and roosting owls, on eBird, or on any publicly accessible social media sites, including but not limited to Facebook and Instagram.
